CASELAW

T-2020-10: State v. Martinez
Held: A suspect in a Terry stop who is asked for an identification under the Failure to Identify statute has the right to know why he/she was stopped, or why is identification requested. Upon being given a lawful reasoning, a suspect must be given the opportunity to provide an ID or a name before he is arrested for Failure to Identify. Does not apply to traffic stops where the driver is required by law to possess and display on request a valid driving license.
